  1. Introduction

Welcome to Spence Counseling Center.  We are committed to protecting the privacy and confidentiality of our client’s personal and health information. This Privacy Policy outlines how we collect, use, disclose, and protect your information when you receive services at our mental health counseling center.

 

We will also provide you with a Notice of Privacy Practices (Notice), which follows the Consent.  The law requires that we provide you with this information and obtain your signature acknowledging that you have received, read, and understand the Consent and Notice which are in our client intake packet.

  1. Information We Collect

We may collect the following types of information:

  • Personal Identification Information: Name, address, date of birth, phone number, email address, and emergency contact.
  • Health Information: Mental health history, medical history, treatment plans, session notes, insurance information, and any other information shared during counseling.
  • Psychiatric Services: Medical history, medication management, and other information shared related to care.
  • Payment Information: Credit card details or other billing information, if applicable.

 

An evaluation may last from 1 of 3 sessions and this will include a diagnosis (usually required by your insurance company).

  1. How We Use Your Information

We use your information to:

  • Provide mental health services and coordinate care
  • Maintain treatment records
  • Communicate with you regarding appointments and care
  • Process payments and insurance claims
  • Comply with legal and regulatory obligations
  1. Confidentiality and Disclosure

All client information is kept confidential and secure, in compliance with:

  • HIPAA (Health Insurance Portability and Accountability Act)
  • Applicable state laws

Exceptions to confidentiality include:

  • Risk of harm to self or others
  • Suspected abuse or neglect of a minor, elderly person, or vulnerable adult
  • Court order or legal subpoena
  • To other healthcare professional for coordinated care

Your written consent is required to release information to third parties unless otherwise required by law.

  1. Data Security

We implement appropriate administrative, technical, and physical safeguards to protect your personal and health information from unauthorized access, disclosure, alteration, or destruction.

  1. Your Rights

You have the right to:

  • Access your treatment records.  (See Terms & Services for fees charged.)
    • Because records can be misunderstood, it is best to examine them with the therapist or another mental health professional.
    • In unusual circumstances, if the therapist believes the disclosure would physically, emotionally, or psychologically harm the client the request will be denied.
  • Request corrections to your records.  We may say “no” to your request but will notify you in writing within 60 days.
  • Request restrictions on certain uses or disclosures.
  • Request confidential communications (alternative address or phone number as an example).
  • File a complaint if you believe your privacy rights have been violated.
  • Any complaints you make about the records will be placed in the record.
  • A legal guardian or medical power of attorney can exercise your rights and make choices about your health information if we have documentation of their rights to make those decisions before any action is taken.
  1. Electronic Communications

If you choose to communicate with us via email, text, or other electronic means, please be aware these methods may not be fully secure. We will obtain your consent before using such methods for health-related communication.  See SMS Terms and Conditions Policy.

  1. Third-Party Services

We may use third-party services (e.g., electronic health records, billing platforms) that comply with privacy regulations. These parties are obligated to maintain the confidentiality and security of your information.

  1. Changes to This Policy

We may update this Privacy Policy as needed. Any changes will be posted on our website with a revised effective date.
